Definitions

www.simplyrural.co.nz is trading as Simply Rural under the company Simply Rural Co Limited.

“Simply Rural’
(also referenced as “us”, “our”, “we”) shall mean Simply Rural Co Limited.

“Website” refers to the Simply Rural website www.simplyrural.co.nz.

“Store” refers to the Simply Rural physical store at 2/2 Jupiter Grove, Trentham, Upper Hutt. 

“Customer” (also referenced as “you”, “your”, “their”) shall mean any person viewing the Simply Rural website or purchasing products from the Simply Rural website or in store.

“Products” (also referenced as “goods” or “items”) shall mean products for sale on the Simply Rural website or in store.

“Price” shall mean the purchase price advertised on the Simply Rural website or in store, plus any additional charges payable by the customer to complete the purchase transaction.

“Supplier” shall mean a third party provider of products to Simply Rural or the Customer.


Returns

We would highly recommend in the first instance, contacting our team at Simply Rural - contact@simplyrural.co.nz, if you have any product/s you wish to return for any reason, so we can advise you on the correct procedure.


Unhappy with your purchase?


If you purchase a product that does not meet your requirements on delivery, we have a 14-day money back guarantee on our products.  The product MUST be returned in the same condition as it was dispatched by Simply Rural, including the original display packaging, labels and tags still intact.  All you need to do is pay for the return shipping.  The 14-day money back guarantee starts from the date the customer receives the product.


Wish to exchange?

If you wish to exchange the product due to wrong size or another valid reason, please contact us at contact@simplyrural.co.nz within 48 hours of delivery.   You will need to return the product which MUST be returned in the same condition as it was dispatched by Simply Rural, including the original display packaging, labels and tags still intact.  All you need to do is pay for the return shipping.  Once we have received the product back at our depot and accepted the product as undamaged, we will credit your account and you can complete a new purchase for the correct product.


Damaged product on delivery

On delivery please check your packaged parcel before signing with the Courier, as ALL products are checked prior to shipping.  If damage occurs on transit you will need to raise this with the Courier driver before signing.  If damage to the packaging is noticed after signing the receipt of the delivery, then please let us know immediately at contact@simplyrural.co.nz so we can help advise you through the claims process.


Cancellation of purchase

Simply Rural are under no obligation to refund money or stop the delivery of products once the customer has confirmed the purchase and paid for the transaction.  For cancellation of the purchase we would highly recommend the customer contact us at contact@simplyrural.co.nz immediately to discuss options.


Incorrect product delivered?

We check every order before being dispatched, however if you find an incorrect product has been sent, please contact us at contact@simplyrural.co.nz within 24 hours of delivery.  We will pay for the return of the product, but you will need to package the product up and it MUST be returned in the same condition as it was dispatched by Simply Rural, including the original display packaging, labels and tags still intact.


Faulty products

If you find the product is faulty, or unfit for purpose please contact us at contact@simplyrural.co.nz as soon as possible.  We will pay for the return of the product, but you will need to package the product up and it MUST be returned in the same condition as it was dispatched by Simply Rural, including the original display packaging, labels and tags still intact.  If we or the manufacturer confirms the product faulty then we will arrange for a replacement to be sent or if the same product is no longer available, then we will offer a full refund.


Products out of stock

If for any reason we are unable to supply a product you have ordered, we will notify you within 48 hours and we will refund your money for the relevant product.


Opened bags of treats or food bags

Please be aware we are unable to accept the returns of any opened bags of treats.


Opened bags of food

If the food you have purchased does not agree with your dog, either with an upset tummy or they are just not interested in the food, then some of the food companies offer a 100% money back guarantee.  In the first instance, please contact us at contact@simplyrural.co.nz to establish whether you can send the food back to us under these circumstances.

If the brand of food purchased does not fit into the above category then we are unable to accept, exchange or refund money for any opened bags of food.


Warranties

All products purchased, for personal use and not for the purpose of trade, will be covered under the Consumers Guarantees Act 1993.

Any product that comes with a specified manufacturer’s warranty will be covered for faults, defects or failures likely to be caused during the manufacturing of the product.  These warranties do not cover damage or faults caused by misuse, impact, water damage, wear & tear and natural disasters.

If a product is NOT fit for purpose or a warranty claim applies, please contact us at contact@simplyrural.co.nz immediately.  We will need proof of purchase for the product, all your contact details and as much information on the identifiable fault or issue and further details on how it came about.

We will require you to return the product to us, so we can assess the fault or damage within 14-days.  Once we have identified and accepted the product is in fact covered by the Consumers Guarantees Act 1993 or under the Manufacturers warranty, we will opt to either replace the product or if the product is no longer available, we will offer a full refund.

Where the product is purchased for the purposes of business use, the guarantees contained in the Consumers Guarantees Act 1993 and Manufacturers warranty are excluded.


Prices

Product prices advertised on our website are in NZ dollars and include GST.  Unless stated, the price excludes the cost of delivery.  These costs will be added at the time of check out.

If for any reason we identify a genuine error in our pricing, we reserve the right to revoke or adjust an order, on an “error and omissions excepted” basis.  

Prices advertised on the website are subject to change without notice, however if a product has been purchased before the price change, that is not covered under an “error and omissions excepted” basis, we will honor the purchase price if the Customer has already confirmed and paid for the relevant purchase of the product.


Supply

We have endeavored to provide accurate, up to date and complete descriptions of the products for sale on our website.  However. we shall NOT be liable for inaccurate, out of date or incomplete information on advertised products.

Simply may rely on third party suppliers for the information that appears on our website including photos, descriptions and tips.  As such we cannot be held liable for the supply of incorrect advertising material or information from third party suppliers.

The products remain the property of Pets United until payment has been received in full and the products have been delivered and received by the Customer.

We will endeavour to show on the website if a product is out of stock, but if in the transition of the website being updated, a Customer orders a product that is out of stock, we will notify the Customer as quickly as possible.  In this case we will credit a full refund to your account and if you wish you can complete a new purchase for another product.

We are not obligated to inform our Customers when any out of stock products are back in stock and are available for purchase.  We will endeavour to keep our website up to date to reflect the products in stock and currently for sale.

An order is deemed complete once the customer has confirmed and accepted the purchase and payment has been received in full by Simply Rural.  A confirmation email of acceptance will be sent by us to the Customer.


Payment

We require full payment of all products purchased on check out.  The payment options are outlined on our website.

The products will only be dispatched once full payment is received, including any delivery costs.

Your use of our payment system is confirmation that you have the authority and the power to validly enter the transaction through our website and that you are using a credit or debit card legally in your name.

With our use of a third-party payment system through our website you acknowledge you consent to the use of that payment system and agree to also comply with the third-party payments system’s terms and conditions.

Simply Rural will not collect or hold your credit card information.


Accounts

When purchasing products from Simply Rural website the Customer will need to provide us with personal information, either on check out or by creating an account.  The information given must be current and accurate.  The Customer must be representing themselves and not a third party.

Customers may not purchase products using another person’s account without permission from the account holder.

The customer MUST keep their user name and password confidential and not disclose it to any third party.

We MUST be notified immediately if there is any unauthorised activity on the customers account or there is suspicion that their username or password have been compromised.

It is the customers responsibility to inform us if they no longer require their account, so it can be deleted.

We reserve the right to decline or terminate an account or refuse to trade with any Customer for any reason. This will be at our sole discretion and without notification.  


Privacy

The customer authorises Simply Rural to collect, retain and use any information about the customer, for the enforcing any rights under any contract to purchase goods or marketing any goods by Simply Rural.

We will use your information to respond to you regarding the purchase of products through Simply Rural website. We will not share your information with any third-party organisation, other than as necessary to fulfil your transaction.

We use cookies, which is a piece of data stored on a Customers hard drive to help improve your access to our website.  Usage of cookies does not link to any identifiable information on our site.

This website contains links to other sites.  Please be aware we are not responsible for the content or privacy practices of the other sites.  We encourage our users to be aware when they leave our site to read the privacy statements of any other site that collects personal identifiable information.

Unless you opt out, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.


Legal

Simply Rural and the website www.simplyrural.co.nz is owned and operated by Simply Rural Co Limited which is a registered company in New Zealand under company number 8713770.

Failure by Simply Rural to enforce any terms and conditions contained in this contract shall not be deemed to be a waiver of the rights or obligations Simply Rural has under this contract.

The law of New Zealand shall apply to this contract except to the extent expressly negated or varied by the contract.

If any provision of these terms and conditions shall be invalid, void or illegal or unenforceable the validity existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.

Simply Rural reserve the right to amend the terms and conditions outlined herewith without notice to any other parties.

Simply Rural shall not be liable for any delay or failure to perform its obligations if the cause of delay or failure is beyond its control.


Shipping & Delivery

All deliveries are by Courier with a signature required.  All parcels are tracked, and you will be provided with a tracking number.  

Courier’s will not leave your parcel unless you are there to sign.  They will leave a calling card which you can contact them and organise a suitable time or place to collect your parcel.  Make sure you check for any damages to the parcel before signing.  Please note that during COVID-19 restrictions the Courier's are NOT requiring signatures on delivery and this is beyond our control.

Our commitment to you, is that all orders will be dispatched as quickly as possible, however we are sometimes having to source items from third party Wholesalers which may cause minor delays.  

No orders will be dispatched over the weekend or public holidays.

We endeavour to have the product/s delivered to you within 1-7 working days.  Please be aware delivery targets can only be estimated as this is out of our direct control due to the reliance of a third-party.

Please be aware we do not ship outside of New Zealand.
